Permanent total disability after an Alabama work accident

Regardless of the industry and occupation where you are employed in Alabama, you are exposed to some level of risk. An office worker may not be as likely to be exposed to the hazards that construction or farm workers may face. However, in the event of a work-related injury, returning to your regular job duties afterward may be difficult or impossible. According to the Alabama Department of Labor, you may qualify for permanent total disability if your injury or illness prevents you from finding consistent work in your current field that you are able to perform with reasonable accommodations. You do not have to be completely disabled to qualify for lifetime benefits, but they would end if you undergo vocational rehabilitation.

Your employer may offer to pay for vocational rehabilitation if you cannot return to your previous job. However, this is only possible if the doctor who has been treating you and a vocational rehabilitation specialist both provide a written statement that the training is in your best interests and would, in fact, provide you with the ability to find gainful employment.

As long as you are eligible for permanent total disability, you would receive 66 2/3 percent of your average weekly earnings. All of your current and ongoing medical needs related to the occupational injury or illness would also be covered unless you choose to receive treatment from a provider who has not been approved.
